As stated in the appeal of the Odessa Department, before being appointed head of the State architectural and construction inspection Sergey Kuzmin held a number of senior positions. In particular, he was the Director of GP "state Specialized expert organization – Central service of Ukrainian state building expertise" (GP "Gosstroyekspertiza"). According to the legislation of GP "Gosstroyekspertiza" provides expert evaluation of construction projects and checks the assignment of the class consequences of the construction. At the same time, the head of Gosarhstroyinspektsii directs the activities of the organization in the sphere of the state architectural and construction control.

Operation Gosarhstroyinspektsii and GP "Gastrotoxicity" as close and connected. S. Kuzmina may occur private interest in the sphere where he performs his authority in the acceptance or rejection decisions.
So a potential conflict of interest S. Kuzmina exist during the Commission of the state architectural and construction control subordinate authority to comply with expert requirements of the law in urban planning, building codes and standards when carrying out the preparatory and construction works.
In accordance with the law, officials should avoid conflicts of interest, and also to report that this situation has arisen.
Therefore, the Odessa Department of Gosarhstroyinspektsii addressed in NACP with the question – did S. Kuzmin to the Agency about the existing conflict of interest and explained to him in NACP the order of his actions.
